Terms of Use

1. Acceptance of Terms
By accessing or using the Clarity Women's Membership platform ("Platform"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Clarity Women's Membership (ABN 16 601 110 098) ("Clarity", "we", "us", or "our"). If you do not agree to these Terms, please do not use the Platform.
2. Eligibility
The Platform is intended for women aged 18 years and over who are residents of Australia. By registering an account, you confirm that you meet these eligibility requirements. We reserve the right to terminate accounts that do not comply with this requirement.
3. Membership and Subscriptions
Clarity offers three membership tiers: Essential, Premium, and Elite, available on monthly or annual billing cycles. All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.
Subscriptions are managed through Stripe. By subscribing, you authorise Stripe to charge your nominated payment method on a recurring basis at the applicable subscription rate. You may cancel your subscription at any time through the Billing Portal accessible from your Account settings; cancellation takes effect at the end of the current billing period.
We reserve the right to modify subscription pricing with reasonable notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
4. Refund Policy
Subscription fees are generally non-refundable. If you believe you are entitled to a refund due to a billing error or exceptional circumstances, please contact us at [email protected] within 14 days of the charge. We will assess refund requests on a case-by-case basis in accordance with the Australian Consumer Law.
5. Giveaways and Competitions
Giveaways and competitions hosted on the Platform are subject to the Competition Terms and Conditions. Entry into a giveaway constitutes acceptance of those terms. Giveaways are open to active members only and are subject to applicable Australian laws, including the Lotteries Act in the relevant state or territory.
6. Affiliate Program
Participation in the Clarity Affiliate Program is subject to approval and the additional terms provided upon acceptance. Affiliates earn commission on referred subscriptions at the rate specified in their affiliate agreement.
We reserve the right to modify commission rates, suspend, or terminate affiliate accounts at our discretion, including where we suspect fraudulent activity or breach of these Terms.
7. User Conduct
When using the Platform, you agree not to:
- Post content that is unlawful, defamatory, harassing, abusive, or discriminatory;
- Impersonate any person or entity or misrepresent your affiliation;
- Attempt to gain unauthorised access to any part of the Platform;
- Use the Platform for any commercial purpose without our prior written consent;
- Share your account credentials with any other person;
- Engage in any conduct that could damage, disable, or impair the Platform.
We reserve the right to remove content and suspend or terminate accounts that violate these standards.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is owned by or licensed to Clarity and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. To the extent permitted by law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Clarity will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability to you for any claim arising from these Terms or your use of the Platform will not exceed the total subscription fees paid by you in the three months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising from these Terms.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.
